Personal data protection

INFORMATION on the processing of personal data according to EU Regulation 2016/679


The purpose of this information is to describe how Evergent Investments SA (Evergent Investments or the Company) treats your personal data.
The website www.evergent.ro represents the online platform under which EVERGENT INVESTMENTS S.A. communicates. together with the e-mail correspondence addresses mentioned in the Contact module.
Evergent Investments as AFIA (Alternative Investment Fund Manager) is authorized by the Financial Supervisory Authority with no. 20 / 23.01.2018, operates in compliance with the provisions of Law no. 74/2015 on alternative fund managers, Law 24/2017 on issuers of financial instruments and market operations, Law 297 on the capital market, Law 31/1990 on companies and of the ASF regulations issued in application of the primary legislation.
Evergent Investments processes the personal data to which it has access in accordance with European Regulation no. 679/2016 (hereinafter “Regulation” or “Regulation”) on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46 / EC (General Data Protection Regulation) ) based on the legal obligations and the legitimate interests of the Company and its shareholders.
The company ensures compliance with all the principles provided by Regulation no. 2016/679 regarding the processing of personal data to which he has access.
The processing of personal data is performed by automated and manual means, in compliance with legal requirements and under conditions that ensure the security, confidentiality and respect for the rights of data subjects.


Definitions


In this document: "data subject" or "user" means any natural person identified or identifiable as a result of the processing of personal data by Evergent Investments as a result of accessing, reading and using the site or sending e-mail. on one of the indicated addresses of the company. "Site" means the Internet address of the Company, respectively evergent.ro.


Legitimate grounds for personal data processing and data transmission


Evergent Investments processes personal data either as a regulated entity / authorized / supervised by ASF, or as an issuer of securities listed on the regulated market, or as a contractual partner, or in other particular cases, which may appear in the activity of the Company.
Data processing is performed for the execution of a legal obligation, for the conclusion or execution of a contract, for the protection of a legitimate interest, public interest or vital interest, such as: ensuring the exercise of rights to information, dividends, participation and voting in general meetings, contact (including by mail, e-mail, fax, text messages or telephone in connection with the aforementioned rights).

Data subjects and personal data processed


Shareholders: in accordance with the applicable legal regime, the register of Evergent Investments Shareholders is maintained and updated by the Bucharest Central Depository (www.depozitarulcentral.ro) from which information is taken at consolidation dates (reference date, registration date, others) containing personal data corresponding to the shareholders of Evergent Investments.
In order to fulfill the information and response obligations to the correspondence with the shareholders, data taken from the site and from the e-mail correspondence with the shareholders (correspondence addresses, telephone numbers, etc.) are also processed.
Clients and suppliers: Evergent Investments concludes contracts with various suppliers or clients, respectively financial investment services companies, market operators, central depository, custodian-custodian, internet service providers, utilities, etc. and other. In these cases, personal data of the natural persons representing the supplier or the possible supplier, the customer or the potential customer are processed. These data are either public or received from the respective collaborators.
Evergent Investments manages IT systems that manage applications (electronic voting general meetings, online access to general meetings) to which shareholders (their legal representatives) have access. We store personal data about users and monitor user access to these systems to protect us from abuse of our systems. The processing of personal data in the context of access by users of our systems is based both on a legal obligation of Evergent Investments and on the legitimate interest to ensure high security in the field of IT and to counter abuse our systems.
